Terms of Service

1. Acceptance of Terms
By downloading, installing, or using Widgety Maker (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. We reserve the right to modify these Terms at any time. Your continued use of the App following any changes constitutes acceptance of those changes.
2. Description of Service
Widgety Maker is a mobile application for iOS that allows users to create, customize, and deploy widgets for their iPhone home screen, lock screen, and StandBy mode. The App includes a Community feature where users can share and discover widgets created by others. The App offers both free features and premium features available through a Pro subscription.
3. No Account Required
The App does not require account creation or login. An anonymous device identifier is used for Community features (sharing widgets, voting). You are responsible for the content you share through the Community feature.
4. Subscriptions
The App offers a Widgety Pro subscription that unlocks premium elements, features, and capabilities. Subscriptions are billed on a recurring basis (monthly or annually) through your Apple ID account. Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage and cancel your subscriptions in your iPhone Settings > Apple ID > Subscriptions. All purchases are subject to Apple's terms and conditions.
5. User Content
You retain ownership of all widgets and designs you create using the App ("User Content"). By uploading User Content to the Community feature, you grant Widgety Maker a non-exclusive, worldwide, royalty-free license to display, distribute, and make your content available to other users. You represent and warrant that your User Content does not infringe on any third party's intellectual property rights, privacy rights, or any applicable laws. We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate, offensive, or harmful.
6. Community Guidelines
When using the Community feature, you agree not to: upload content that is offensive, hateful, violent, or sexually explicit; harass, bully, or intimidate other users; impersonate any person or entity; upload malicious content or spam; use the community to advertise or promote products or services without our consent; violate any applicable local, state, national, or international law. The App includes a profanity filter that screens submissions for inappropriate language, a Report button to flag inappropriate widgets for review, and a Block feature so you can hide all widgets from any specific creator. Violations may result in your content being removed and your device being blocked from the Community feature. Reports are reviewed and we aim to act on confirmed violations within 24 hours.
7. Intellectual Property
The App, including its design, features, code, graphics, and branding, is owned by Widgety Maker and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App or its content without our prior written consent. Templates and design assets provided within the App are licensed for personal use through the App only.
8. Third-Party Content and Services
The App integrates with third-party services including Open-Meteo (weather), Apple HealthKit, Klipy (stickers), Pexels (stock images), Wikipedia (On This Day historical content), and financial data providers (Yahoo Finance, CoinGecko). Third-party content is provided "as is" and we make no warranties regarding its accuracy, availability, or fitness for any purpose. Stock and cryptocurrency data is delayed and should not be used for financial decisions. Weather data is provided by Open-Meteo under the CC BY 4.0 license. Stock photos are provided by Pexels with photographer attribution shown in the App. Historical "On This Day" content is sourced from Wikipedia under the CC BY-SA 3.0 license.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Widgety Maker shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising out of or in connection with your use of the App. Our total liability shall not exceed the amount you have paid us in the twelve (12) months prior to the claim.
10. Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or completely secure.
11. Termination
We may block your device from Community features at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Your locally stored widgets and projects are unaffected by any Community restrictions. Provisions of these Terms that by their nature should survive termination shall survive.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Widgety Maker operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association.
